Terms of Service

The terms and conditions governing access to and use of the EE-IX platform and interconnection services.

EE-IX Terms of Service

These Terms of Service ("Terms") govern participation in EE-IX (European Edge Internet Exchange), a brand operated and fully managed by Airbytes Communications Limited, a company incorporated in England and Wales.

1. Definitions

"Airbytes" means Airbytes Communications Limited, incorporated in England and Wales.

"EE-IX" / "European Edge Internet Exchange" / "European Edge IX" means the Internet Exchange platform operated as a brand and trading name of Airbytes Communications Limited.

"Member" means any organisation that has entered into a service agreement with Airbytes for participation in EE-IX.

"Platform" means the EE-IX Layer 2 peering fabric, route servers, switching infrastructure, member portal, monitoring systems, and associated interconnection facilities.

"Services" means all interconnection and related services provided under the EE-IX brand, including public peering, private network interconnects (PNIs), remote peering, cross-connect services, and related offerings.

"Port" means the physical or virtual Ethernet interface allocated to a Member for connection to the Platform.

2. Membership and Eligibility

Membership is open to organisations that operate an Autonomous System Number (ASN) and demonstrate a legitimate requirement for interconnection.

Airbytes reserves the right to approve or decline membership applications at its sole discretion.

By applying for membership, the applicant confirms that the information provided is accurate and that they are authorised to bind their organisation to these Terms.

3. Service Provision

EE-IX provides Layer 2 Ethernet connectivity between Member ports on the Platform.

Members are responsible for:

Airbytes does not guarantee the availability of any specific peering partner or traffic volume.

Airbytes shall use commercially reasonable efforts to maintain Platform availability at 99.99% monthly uptime, excluding scheduled maintenance (announced at least 5 business days in advance), emergency maintenance, and events outside reasonable control.

Unless expressly agreed in writing, Services are provided on a best-effort basis.

4. Member Obligations

Members agree to:

Members remain fully responsible for the security and integrity of their Autonomous System.

5. Fees and Payment

Service fees are published on the EE-IX website and may be updated with at least 60 days’ written notice.

Invoices are issued monthly in advance and are payable within 30 days of the invoice date.

Late payments may incur interest at 4% above the Bank of England base rate.

Airbytes reserves the right to suspend Services for accounts overdue by more than 30 days.

6. Intellectual Property

All intellectual property rights in the Platform, website, documentation, software, and EE-IX branding remain the exclusive property of Airbytes Communications Limited.

Members may not use EE-IX trademarks or branding without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Airbytes’ total liability for any claim arising from or related to these Terms or the Services shall not exceed the total fees paid by the Member in the 12 months preceding the claim.

Airbytes shall not be liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or business opportunity.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

8. Suspension and Termination

Airbytes may suspend or terminate a Member’s access immediately if the Member breaches these Terms, the Acceptable Use Policy, or engages in activity that threatens Platform integrity.

Either party may terminate the membership agreement by providing 30 days’ written notice.

Upon termination, all outstanding fees become immediately payable and the Member must disconnect from the Platform within 10 business days.

9. Force Majeure

Neither party shall be liable for failure to perform obligations due to causes beyond its reasonable control, including natural disasters, war, terrorism, pandemic, government actions, power failure, or telecommunications failure.

10. Confidentiality

Both parties agree to keep confidential any non-public information received in connection with the Services, except where disclosure is required by law or authorised in writing.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Amendments

Airbytes may amend these Terms by publishing a revised version on the EE-IX website and notifying Members by email.

Continued use of the Services after the effective date of any amendment constitutes acceptance of the revised Terms.
